If you are found in possession of even one tab of Ecstasy (MDNA) then you
can be charged with a State Jail Felony. The DA must prove (1) that you
knew that the substance was Ecstasy (MDMA), and (2) that the Ecstasy (MDMA)
was under your actual care, custody, control, or management.
Penalties for Possession of a Controlled Substance
There is a wide range of punishment for the charge of the possession of
ecstasy (MDNA). The amount of the fine and the amount of jail or prison
time depends on the amount of the ecstasy (MDNA) that was found in your
possession. If you have received a final conviction for possession of
ecstasy (MDNA) then you will also receive a driver's license suspension.
You have received a final conviction for possession of ecstasy (MDNA)
if you have served time, or paid a fine and did not do probation. Less
than one gram of ecstasy (MDNA) can result in 2 years in state jail and
up to a $10,000 fine. If you are found in possession of at least 4 grams
but less than 400 grams of ecstasy (MDNA), then you can be sent to prison
for 2 to 20 years and fined up to $10,000.00.
